Terms and conditions of sale

Preamble

These general terms and conditions of sale apply to reservations of rooms, the gîte and additional services made with the Maison des Monts d'Or. They are those in force at the date of confirmation of your reservation on the various sites offering our services. They cancel and replace any general conditions of sale previously published online and/or accepted by the customer. They are deemed to have been read and accepted by the customer at the time of booking online or by telephone.

Length of stay

The customer signing the contract must be over 18 years of age (legal majority in France). He/she enters into the contract for the length of time specified in the reservation and may not, under any circumstances, claim any right to remain in the property. If you wish to extend your stay, this will be done in consultation with the service provider, subject to availability.

Arrival time

We are pleased to welcome you between 5:00 pm and 7:30 pm from Monday to Sunday. If you wish to arrive earlier or later, please specify this at the time of booking.

Check-out time

Please vacate the room and gîte by 11:00 am at the latest. You have a room to leave your luggage before you receive your keys and after you have vacated your room if necessary.

An extra day will be charged if the departure time is not respected.

Breakfast service

Breakfast is served between 7:00 and 9:00 a.m. Monday to Friday, and from 8:00 to 10:00 a.m. on weekends and public holidays. If you wish to be served earlier, please inform us either when booking or on arrival.

Snacks, picnics and meals are not permitted in the rooms and common areas, with the exception of the dining room.

Parking facilities

An enclosed, uncovered private parking lot is available.

2 recharging points for electric vehicles are available (a fixed charge per recharging is proposed).

Accessibility

For safety reasons, we are unable to accept guests with reduced mobility.

No smoking inside the building

For safety reasons and for everyone's comfort, smoking is strictly prohibited in the guest rooms, gîtes and communal areas. Ashtrays are available outside.

Internet access

La Maison Des Monts d'Or provides wifi internet access throughout the establishment. The customer undertakes to ensure that the computer resources made available are not used for fraudulent or illegal purposes, and in particular to commit any act of infringement of third-party rights, piracy and/or illegal downloading protected by copyright or neighboring rights sanctioned by the Intellectual Property Code. The choice to use the wifi of La Maison Des Monts d'Or is made under the entire responsibility of the customer and releases the service provider from any liability concerning its use.

Pets

Pets are not allowed.

Swimming pool access in season

The swimming pool is open daily from 10:00 am to 7:00 pm (May to September, weather permitting). Swimming is unsupervised. Minors must be accompanied by their parents and/or an adult with authority, who are solely and exclusively responsible for their care and supervision.

We reserve the right to refuse access to the pool if there is any doubt about the quality of the water.

More generally, guests undertake to comply scrupulously with all the owner's instructions regarding access to and use of the pool area.

Pétanque court

A pétanque court is available daily from 10:00 am to 7:00 pm. Games of boules are available. As with the swimming pool, minors must be accompanied by their parents and/or an adult with authority, who are solely and exclusively responsible for their care and supervision. 

Capacity

The contract is drawn up for a specific number of people. If the number of guests exceeds this number, or does not comply with the terms of the booking, the service provider is entitled to refuse additional guests. This refusal can in no way be considered as a modification or breach of contract on the initiative of the owner, so that in the event of the departure of a number of customers greater than those refused, the price corresponding to the cost of the accommodation remains the property of the provider.

However, depending on the nature of the disagreement, the supplier may propose an amicable solution to suit both parties, subject to availability (e.g. rental of an additional room).

Rates and payment

Rates are per night for 1 or 2 people, including breakfast (for chambres d'hôtes only).

Payments are to be made by bank transfer or credit card when booking online or on site, and by check, credit card or cash when paying the balance of services.

Personal information

Pursuant to Law No. 2018-493 of June 20, 2018 on the protection of personal data and the General Regulation on Data Protection RGPD, the customer is informed that the information provided at the time of booking is subject to the processing of personal data for the purposes of managing reservations and customers, billing and payment requirements, as well as for commercial prospecting purposes.

During their stay, customers may be photographed or filmed at events organized and attended by them. For commercial purposes, these photos and/or films may be published on La Maison des Mont d'Or's social networking sites: website, Facebook, Instagram, etc. Customers have the right to access, rectify and delete their personal data.

They are therefore invited to inform the establishment's service provider during their stay of their refusal to be filmed or photographed. They may also exercise this right by writing after their stay to the following e-mail address: bienvenue@lamaisondesmontsdor.fr or by post to La Maison des Monts d'Or 11 rue du lurin 69650 Saint Germain au Mont d'Or. The service provider thus undertakes not to distribute or delete photos and films concerning him or her.

Insurance

The service provider declares that he has taken out specific insurance cover for "bed and breakfast and furnished holiday accommodation" with an insurance company, the description and policy number of which can be supplied on request.

The customer is responsible for all damage caused by himself or by persons accompanying him under his responsibility. They should therefore check whether their main home insurance policy includes a holiday rental extension. The customer certifies that he/she is covered by a civil liability insurance policy covering his/her own liability and that of the persons accompanying him/her.

However, the supplier and/or his insurance company reserve the right to hold the customer liable in the event of damage, malice and/or negligence on his part.

Disputes

These General Terms and Conditions of Sale are governed by French law. It is recommended to favor the amicable settlement of disputes by having the object of the dispute established on the same day, for immediate resolution or as soon as reasonably possible by the 2 parties

If the customer makes a complaint after leaving the establishment, he has 7 days in which to do so, either :

• By post by registered letter with acknowledgement of receipt to La Maison des Monts d'Or 11 rue du lurin 69650 Saint Germain au Mont d'Or.
• By e-mail with acknowledgement of receipt to bienvenue@lamaisondesmontsdor.fr

After this deadline, no claim can be made. If the complaint is made within 7 days of the customer's departure, the establishment will deal with it within a maximum of 14 days following the complaint, in order to reach an amicable resolution in line with the interests of both parties.

If the dispute persists, only the courts of the jurisdiction of La Maison des Monts d'Or will have jurisdiction.

Tourist tax

The tourist tax is a local tax that the customer must pay to the service provider, who then transfers it to the public treasury. It is currently set at €0.83 per day per adult for the total length of the stay. of the stay. It is payable by the customer on presentation of the invoice. 

Booking conditions and cancellation

Reservation guaranteed by payment of a deposit of 40% of the total cost of your stay by cheque, credit card valid at the start of your stay or bank transfer.

The balance is paid on site at the end of your stay, by credit card, cheque or cash.

Payment of extras and any supplements due on departure from the guesthouse can be made by credit card, cheque or cash.

In accordance with article L121-20 of the French Consumer Code, all consumers have 7 days from the date of booking to exercise their right of "retraction", without having to justify their decision or pay any penalties, with the exception of any return costs.

After this period, the sums paid in advance, constituting ARRHES, are subject to the following conditions: 

• free cancellation possible up to 20 days before arrival
• less than 20 days to 7 days prior to arrival: 50% deposit retained
• cancellation 7 days before arrival or no-show: deposit retained

Reminder of General Sales Conditions

The general terms and conditions of sale are modified on a regular basis, particularly in the event of changes to standards, regulations or laws.

The general terms and conditions of sale, including the confidentiality policy, the general terms and conditions of use of the site and, where applicable, any special terms and conditions specific to certain offers, constitute the entire contract between the customer and Maison Des Monts d'Or, concerning his reservation on the sites and cancel all other previous general terms and conditions of sale.

In the event of one of the stipulations herein being declared null and void in whole or in part, for any reason whatsoever, the other stipulations shall remain in force.
